1. What this page is

1.1. A substantial part of the Services — above all dedicated servers, and also certain virtual server configurations — is delivered by the Provider using the equipment of third-party operators (Infrastructure Operators). The Provider is generally not the owner of that equipment and has no physical access to it.

1.2. This page serves three purposes:

1) it publishes the current list of Infrastructure Operators and the countries where equipment is located (clause 5.8 of the Agreement);
2) it provides access to each Operator's acceptable use rules, compliance with which is the Customer's obligation (clause 5.9 of the Agreement);
3) it explains what this means in practice for the Customer.

1.3. This page may be updated without issuing a new version of the Agreement. A change to the list of Operators requires no fresh acceptance; it affects a specific Customer's Service only through clause 12.9 of the Agreement (migration, or termination with a refund).

3. What this means for the Customer

3.1. You must comply with two sets of rules

The Provider's Rules (the Agreement and Annex 1) and the rules of the Infrastructure Operator on whose equipment your Service is hosted. Where they conflict, the stricter rule applies (clause 5.9 of the Agreement).

3.2. An Operator can shut the server down on its own

An Infrastructure Operator is not a party to the Agreement. It may restrict or terminate the operation of equipment without the Provider's agreement — upon a complaint, to comply with a decision of an authority of its own jurisdiction, because of an incident, or for breach of its own rules (clause 5.10 of the Agreement). The Provider cannot always prevent this technically.

3.3. Response deadlines can be very short

When a complaint reaches the Operator, it gives the Provider its own deadline — sometimes a few hours. The period the Provider can give you shrinks accordingly. The shortened-deadline scale is in Section 4.5 of Annex 2.

Practical conclusion: keep contact details in the Client Area that reach you quickly, and respond to the Provider's messages within an hour, not within a day.

3.4. Equipment outside Ukraine

This has two consequences, described in clause 16.5 of the Agreement and Section 7 of Annex 6: authorities of a foreign jurisdiction may approach the Operator directly, and compliance with a Ukrainian court ruling requiring physical access to equipment may be impossible for the Provider.

3.5. Why the paid period is not refunded

This is not the Provider's stance but a direct reflection of the terms on which the Provider itself obtains the equipment. Below are extracts from the Infrastructure Operators' terms in force as at 17 September 2026.

The above is an extract for explanation, not a substitute for the Operators' terms. Each Operator's current terms are available via the link in the table in Section 2 and prevail over this summary. The Provider updates this page when those terms change.

What follows from this. The Provider reserves equipment for the whole selected Billing Period and pays for it in advance. Amounts paid to an Operator are generally non-recoverable, in whole or in part, where use ends early. Clause 5.2 of Annex 5 therefore applies the same rule to the Customer — otherwise the Provider would be paying out of its own pocket for a period already paid to the Operator.

That said, the Provider's right not to refund the price of the paid period is established by the Agreement and does not depend on whether the Provider obtained any recovery from a particular Operator in a particular case. Where a recovery is obtained, the Provider passes the corresponding amount on to the Customer, less costs actually incurred (clause 5.2.6 of Annex 5).

What the Provider gives beyond the Operators' terms:

1) declining renewal within the period set by clause 11.3 of the Agreement, with no deductions and no requirement to pay off a commitment balance (unlike OVHcloud and Scaleway);
2) a full refund where an Operator ceases to supply the equipment — at the Provider's expense (clause 12.9 of the Agreement), even though the Provider receives nothing back from the Operator in that case;
3) preservation of Consumer Customer rights to the extent required by law (clause 5.3 of Annex 5).


3.6. The Agreement gives no availability guarantee

The actual availability, maintenance and hardware replacement parameters are determined by the Infrastructure Operator. That is precisely why Section 14 of the Agreement establishes no guaranteed level of availability. At the same time the Provider's liability to you for breach of the Agreement remains full — as required by part two of Article 902 of the Civil Code of Ukraine (clause 13.9 of the Agreement).

3.7. Claims go to the Provider, not to the Operator

You have no contractual relationship with the Infrastructure Operator. All claims are brought against the Provider (clause 13.9 of the Agreement).


4. Changing an Operator

4.1. The Provider may change the Infrastructure Operator for a particular Service — on its own initiative or because the relationship with the Operator has ended.

4.2. Where the change affects the country of location or the specifications of the Service, clause 12.9 of the Agreement applies: notice, an offer of migration preserving the specifications or better, and — where migration is impossible or declined — termination with a full refund of the unused balance. Migration is at the Provider's expense.
